Measures to support the return of emigrants to Portugal

VolverThe Labour Law Department of Belzuz Abogados S.L. - Portugal comments on the legal framework of the support to the return of emigrants to Portugal that is governed by Order no. 214/2019 of July 5th. Its main aspects are characterized below.

1 - Goals and purposes of this Measure

The Measure is part of the Return Program. This program aims at supporting the return of emigrant workers (or their descendants) to Portugal to strengthen job creation, payment of contributions to social security, investment and fight against demographic ageing, by guaranteeing safety, stability and comfort to emigrants in their return to Portugal.

The Measure consists in granting financial support directly to recipients via the Portuguese Employment and Professional Training Institute (IEFP, I.P.). In addition, it co-pays expenses concerning transportation of goods and the trips of recipients and respective household members, upon signing of an employment contract in Mainland Portugal.

2 - Recipient requirements

The Measure aids emigrants who cumulatively meet the following conditions:

a) Start their professional activity in Mainland Portugal between January 1st, 2019 and December 31st, 2020, upon signing of an employment contract;

b) Have left Portugal before December 31st, 2015 (Portuguese emigrants are Portuguese citizens who have permanently resided abroad for at least 12 months and have exercised a remunerated activity, whether of employment or self-employment);

c) Have their contributions and tax status settled;

d) Are not in default regarding financial supports granted by the IEFP, I.P.

The Measure also applies to Portuguese emigrant relatives (descendants), provided they gather all conditions described in subparagraphs a) to c) above. For this purpose, an emigrant descendant is the spouse or equivalent, the relative or the like in any degree of the direct line of descent and up to the 3rd degree of the collateral line of descent who have permanently resided abroad with the emigrant for a period of at least 12 months.

3 - Employment contracts that are eligible

The Measure only includes indefinite contracts that meet the following requirements:

a) Start between January 1st, 2019 and December 31st, 2020;

b) Comply with legislation concerning the minimum wage and respective collective labour regulation, when applicable;

c) Are full-time or part-time contracts.

4 - Financial supports granted to recipients of this Measure

Recipients of this Measure are entitled to financial support that corresponds to six times the Social Support Index (currently fixated in 435.76 Eur., granting them with a support up to 2,614.56). For part-time contracts, this support will be reduced in the corresponding proportion.

This financial support is increased in 10% for each household member who take up residence in Portugal and can go up to three times the IAS.

The following supports can also be added:

a) Co-payment of travel expenses to Portugal incurred by the recipient and respective household members up to three times the IAS (Eur. 1,307.28);

b) Co-payment of expenses regarding the transportation of goods to Portugal up to two times the IAS (Eur. 871.52);

c) Co-payment of expenses incurred with the recognition of the recipient’s academic or professional qualifications in Portugal up to an amount equal to the IAS (Eur. 435.76).

Expenses are only eligible if incurred from June 1st, 2018 up to the 12th month following the payment of the first parcel of the support.

5 - Obligations and duties of the recipients of this Measure

Recipients are obliged before the IEFP, I.P. to:

a) Keep their employment contract for at least 12 months;

b) Keep their contribution and tax situation settled from application date and during the support period;

c) Submit their proofs of expenses by the end of the 6th or 12th calendar month following the first support payment;

d) Notify the IEFP, I.P. in writing of any change in address or to the application that was initially approved, namely contract termination and corresponding cause, within 10 business days.

Note that the granting of these supports depends on the application presented by the applicants under the terms and within the deadlines set by IEFP, I.P. at its electronic portal.
