The purchase of a property in Portugal - an apartment, a house, a farm, a plot of land, etc – can be a challenging process.  In order to avoid any surprises during the different stages of the acquisition process, it is recommended that both parties - but especially the buyer - are duly advised by an independent professional with expertise in real estate law. This article explains the main steps that should be followed in a standard acquisition process of a property in Portugal, whether it is done for investment (long term rental, short term rental), or residential purposes.

Twelve years after the Bitcoin system has been founded and after the use of virtual currencies has expanded globally, the Portuguese tax legislation remains unfitted to the new reality of crypto-assets and virtual currencies. It is urgent to define an appropriate tax regime, preferably aligned with the EU policies.

The activitiy of cryptocurrencies in Portugal

 
The transposition to Portugal of several European AML directives has urged the Bank of Portugal to regulate the registration procedure of the cryptocurrency services providers. Thus, a Public Consultation with a drafted regulation project has been in forced until December the 10th, 2020. News on the cryptocurrency matters are soon expected in Portugal.

Regulation for register the Cryptocurrency Companies


The updated AML legislation has included on the list of obliged entities, all entities that perform activities with cryptocurrencies. The same legislation obliges those entities to register before Banco de Portugal, defined as the authority responsible for regulating the access and registration of the said activity. On April 23rd, Banco de Portugal has regulated the rules on registration.

How to register a Portuguese Branch of a Foreign Association or Foundation

It is possible to enroll a permanent representation in Portugal of a Foreign Recreational or Cultural Association or Foundation.

Obligation pour les résidents non habituels de présenter une déclaration de revenus au Portugal
 
Les titulaires du statut de résident non habituel au Portugal bénéficient d'un régime fiscal spécial en vertu duquel, dans certaines circonstances, ils sont exonérés de l’Impôt sur le Revenu portugais ou sont imposés à des taux réduits. Toutefois, pour pouvoir demander l'application de ces normes spéciales, ils devront envoyer leur déclaration de revenus avant le 30 juin.

Plus-values immobilières obtenues par des non-résidents

 
Les tribunaux supérieurs portugais donnent raison aux contribuables non résidents en confirmant la discrimination pratiquée par l'Administration Fiscale et Douanière portugaise qui considère, aux fins de l'impôt sur le revenu, 100 % de la plus-value obtenue par un contribuable non résident au Portugal au lieu de 50 % de ce solde.
